The future of investment and trade arbitration: EU and UK perspectives

About the talk

This lecture will examine the EU approach to trade and investment arbitration, including the Energy Charter Treaty and the recent Komstroy judgment both in the context of the EU principle of autonomy and of public international law.  It will also look at the approach taken by the UK in its new trade and investment agreements.

About the speaker

Christopher Vajda QC was the UK judge at the Court of Justice of the European Union (“CJEU”) from 2012 until the withdrawal of the UK from the EU in January 2020. He has a particular expertise in investor-state dispute resolution following his time as a judge at the CJEU where he sat in Opinion 2/15 on the Free Trade Agreement between the EU and Singapore and in Opinion 1/17 on the Comprehensive Economic and Trade Agreement between the EU and Canada. He has now returned to practice at Monckton Chambers and is a Visiting Professor at King’s College, London.
