About the Lecture:

Is it justified for China to design its private international law to further its national interest? This question entails the examination of two threshold issues. First, does private international law involve national interest? Second, how does China further her national interest through private international law? Through examining the developments of private international law, it is argued that private international law is always heavily shaped by national interest. Using China as a case study, it is illustrated that China has been furthering its interests through expanding its judicial jurisdiction, increasing statutes having extraterritorial application, and streamlining its regime on the enforcement of foreign judgments. Applying the realist theory in international relations, it is concluded that China is justified to develop its private international law in these ways to maximize its chance of survival.

About the Speaker:

Dr. Dicky Tsang is an Associate Professor in the Faculty of Law at The Chinese University of Hong Kong. Specializing in private international law and company law, his research has been featured in leading international law journals. His works have been cited by the US Court of Appeals for the Fifth Circuit, the Supreme Court of Missouri, and in a WTO dispute-settlement case by the European Union. Dr. Tsang was awarded his LL.M. at University College London. He also holds degrees from Georgetown University (S.J.D.), Columbia University (LL.M., J.D.) and the University of Hong Kong (LL.B. and PCLL).
