The book proposes a new model civil procedure code for England and Wales that provides an improved, simplified approach to the rules of court.
A Model Civil Procedure Code for England and Wales by Dr John Sorabji (Associate Professor at UCL Laws) has been published by Oxford University Press.
Civil procedure law is integral to our understanding of access to justice, dispute resolution, and ultimately the rule of law. However, the field is rapidly changing: dispute resolution is shifting away from courts and judgments, and the increasing digitisation of society and potential role of AI will profoundly influence future reforms. In response, Dr Sorabji proposes a new model civil procedure code for England and Wales.
The publication is the first codification of English and Welsh civil procedure which identifies the general principles that underpin and inform it. It incorporates new approaches to litigation cost and funding, and fully incorporates dispute prevention and ODR/ADR into pre-action and post-issue case management. Furthermore, the book emphasises the need for further digitisation and explores how AI may be used to manage and resolve disputes.
